SPECIAL TERMS AND CONDITIONS FOR DISTANCE SELLING AND USE OF THE www.valcenis.ski WEBSITE
1. General
Placing an order implies acceptance by the person (hereinafter referred to as the "Customer") of these special conditions of distance selling and the GTCU, which can be downloaded from the www.valcenis.ski website (the GTCU contain additional pre-contractual information). Should any provision be lacking, it will be considered to be governed by current practice in the distance selling sector for companies with their registered office in France.
These terms and conditions supplement the "General Terms and Conditions of Sale and Use" of the packages displayed at all points of sale and posted online on the website.
The characteristics of the various packages offered for sale (type, period of validity, etc.) are set out in the price list, which can be consulted at the points of sale and/or on the aforementioned website.
Contractual information is presented in French. These conditions apply exclusively to non-trading individuals.
2. How to order
Remote package purchases are made by placing an order online by logging on to the www.valcenis.ski website.
To finalise the order, the Customer must accept these conditions as well as the General Terms and Conditions of Sale and Use of the packages. In accordance with article 1369-5 of the French Civil Code: The Customer has the opportunity to check the details of their order and its total price, and to correct any errors, before confirming it to express their acceptance.
The SEM de Val Cenis will confirm the Customer's order by e-mail. Any order implies acceptance of the description of services and prices.
3. Reloading online
Tickets issued on a Keycard can be topped up using the products offered on the www.valcenis.ski website. There is a 15-minute delay between purchase and the first hands-free terminal. Payment is by credit card only. An acknowledgement of receipt of the order will be sent to the Customer by email, which the Customer must keep, particularly in the event of checks when using the ski lifts.
The ticket will be topped up automatically the first time the Customer passes through the hands-free access terminals. For ski passes valid for 6 days or more, it is specified that the ticket must be activated in Val Cenis with the first passage through the control terminals in order to be recognised in the other resorts of Haute Maurienne Vanoise.
4. Prices and payment terms
This is an order for which payment is required. The prices indicated are inclusive of VAT in euros, taking into account the VAT rate in force on the day of the order.

The price of the order is payable when the order is placed and payments must be made in euros by CB-VISA-EUROCARD-MASTERCARD bank card.) It is specified that payment by bank card is secure via an SSL security platform which guarantees the confidentiality of payments. Payment is made via a virtual payment terminal with immediate payment. At no time does the SEM de Val Cenis have any knowledge of the numbers that the Client must provide. The SEM de Val Cenis is only informed by the banking establishment that a transfer corresponding to the amount of this order has been made to its account.
5. Order confirmation
Confirmed orders involving payment by credit card will be those which have been approved by the bank. Refusal by the Customer's bank to authorise debiting of the Customer's bank account will result in cancellation of the order process, which will be notified to the Customer.
Once the order has been concluded on www.valcenis.ski, the SEM de Val Cenis will acknowledge receipt of this order by e-mail.
6. Order delivery
The Client must collect their lift passes from the automatic ticket machines or from one of the six SEM de Val Cenis sales outlets chosen by the Client at the time of ordering, taking into account the opening hours of the sales outlets.
A copy of the acknowledgement of receipt will then be required by the SEM de Val Cenis as well as the presentation of a valid official identity document. Failing this, the ski passes ordered cannot be issued.
7. No right of withdrawal
In application of article L221-29° of the French Consumer Code, the right of withdrawal provided for in articles L221-18 et seq. of the French Consumer Code does not apply to passenger transport contracts.
8. Order cancellation
Once the package order has been confirmed by the Customer, the package ordered cannot be refunded, taken back or exchanged. Similarly, no changes may be made to the order.

Customers are strongly advised to take out the proposed insurance (Carré Neige Saison or Carré Neige Intégral) at the time of purchase, which will cover cancellation costs.
9. Liability and guarantees
The SEM de Val Cenis will only be bound by an obligation of means for all stages of access to online sales. The SEM de Val Cenis may not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses, and in general for any other event expressly qualified by case law as a case of force majeure.
The Customer declares that he/she is aware of the characteristics and limits of the Internet, in particular its technical performance, response times for consulting, querying or transferring data and the risks associated with the security of communications.
10. Methods of proof
The online provision of the bank card number and, more generally, the final confirmation of the order by the Customer shall constitute proof of the entire transaction in accordance with the provisions of Law no. 2000-230 of 13 March 2000, as well as proof that payment is due. This confirmation constitutes the signature and express acceptance of all operations carried out on the online sales module. It is imperative that the Customer keeps the order confirmation e-mail, as only this document will be deemed authentic in the event of a dispute over the terms of the order, particularly in the event of a check on the ski lifts.
Information relating to the validity of the ticket and written on the support has no contractual value.
11. Protection of personal data
All the information requested by SEM Val Cenis for the issue of a ski pass is compulsory. If one or more items of compulsory information are missing, the ski pass cannot be issued. Certain data (postal address, e-mail, telephone number) may also be requested from Clients by the SEM de Val Cenis, to enable it to send them commercial offers, in accordance with the terms of the LCEN law of 21 June 2004.
Data relating to journeys is also collected for the purposes of managing access to ski lifts and checking tickets. The data is also collected for statistical purposes.
12. Translation and applicable law - dispute resolution
In the event that these general terms and conditions of sale and use are drawn up in several languages, it is expressly understood that the French version of this document is the only authentic version. Consequently, in the event of any difficulty in interpreting/applying any of the provisions of these general terms and conditions of sale and use, express reference shall be made exclusively to the French version. These general terms and conditions of sale and use are subject to French law, both for their interpretation and their implementation. Any disputes that may arise concerning the validity, interpretation, performance or non-performance, interruption or termination of this contract shall be submitted to mediation. The parties to the contract remain free to accept or refuse recourse to mediation. The parties to the contract shall jointly appoint a qualified, independent, neutral and impartial person.
The solution proposed by the mediator is not binding on the parties to the contract. Failing an amicable settlement, the dispute will be brought before the competent courts.
